Welcome to Best Law Tutors Canada (BLTC)! These Terms and Conditions (“Terms”) govern your access and use of our online teaching platform and services (“Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
1. Eligibility:
You must be at least 18 years old and legally capable of entering into contracts to use the Services. If you are enrolling on behalf of a minor, you must be their legal guardian and have their consent to use the Services.
2. Access and Use:
BLTC grants you a non-exclusive, non-transferable license to access and use the Services solely for your personal and non-commercial purposes. You agree to use the Services only in accordance with these Terms and applicable laws and regulations.
3. User Content:
You may submit content (“User Content”) to BLTC, such as written assignments, video recordings, or feedback. You retain all ownership rights to your User Content.
4. User Content License:
By submitting User Content, you grant BLTC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and publicly display your User Content, in whole or in part, in any and all media, formats, and channels, including but not limited to the Services, our website, marketing materials, and promotional materials. This includes the right to create derivative works based on your User Content.
5. User Content Representations and Warranties:
You represent and warrant that:
- You own or have all necessary rights and permissions to the User Content you submit;
- The User Content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights;
- The User Content is not illegal, obscene, defamatory, hateful, discriminatory, or otherwise harmful;
- You will not submit any User Content that contains personal information of any third party without their express consent.
6. Content Moderation:
BLTC reserves the right, in its sole discretion, to remove or prohibit any User Content that violates these Terms or that we deem inappropriate for any reason.
7. Fees and Payment:
You agree to pay all fees associated with your use of the Services according to the posted pricing and terms. BLTC reserves the right to change prices at any time.
8. Disclaimers:
THE SERVICES ARE PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BLTC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability:
TO THE FULLEST EXTENT PERMITTED BY LAW, BLTC WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
10. Indemnification:
You agree to indemnify and hold BLTC harmless from and against any and all claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.
11. Termination:
BLTC may terminate your access to the Services at any time, for any reason, or no reason, with or without notice. You may terminate your account at any time by contacting us.
12. Governing Law:
These Terms are governed by and construed in accordance with the laws of Canada and the province or territory in which you reside.
13. Entire Agreement:
These Terms constitute the entire agreement between you and BLTC regarding your use of the Services.
14. Changes:
BLTC reserves the right to change these Terms at any time. We will notify you of any changes by posting the new Terms on the Services. You are advised to review these Terms periodically for any changes.
